I don't know if this will help you any but here goes, I live in Condo 4 years now, one of the first to move in and they were managed by Jones Lang.
They seemed to be good however the Committee wanted them out. They got QPM who we have now, maybe three or four managers have come and gone, and the problem I experience in Thailand Condos is the laws on the books are not honored for instance it is illegal to rent short time by the day or week. Yet after the article of the law pass 2008 and I read from the Nation here at TV, the Committee and Management refused to acknowledge the law. It took 2 years for us to get them to post on the bulletin board the law as it is written and the penalties financially and prison. Yet after they and others wrote the Government agencies at Wattana and Land office and Commerce Dept. and calling the 1111 telephone number for complaints and they say they reported to the Police nothing has stopped them. Now we read in the blue book the Juristic has the power to cut essential services for Coowners who do not follow the law like cutting off water and power,the management claims they cannot do anything and we need 20 percent or 10000 shares of co owners to call at Extraordinary meeting yet they won't let us post a decent size sign asking to people to join our concerned co owners group. Now they hired a new manager and he seems respectful and open to hear our complaints, so we shall see if it gets better here. I will keep this topic informed of the results but my experience so far is that the Committee is the problem not the Juristic and they control how the building is run and so far not good. #3Posted 2012-02-11 22:28:39
Sorry to hear that you have committee issues. Yes, they can be just as detrimental to a building as an inapt manager. But I do believe in the condo law, you can NOT cut essential services for those that break the bylaws.

The essential services provided by the building eg. fingerscan access, water, and all common area facilities can be denied to owners in arrears of maintanence fee's for more than 6 months., furthermore they are liable for a 20% annualized interest charge on the account overdue. #5Posted 2012-02-13 10:05:53
Wow...thats good to know. But what can be done when unit owners break the condo by-laws? Thats one issue we are having at the moment. Can they be fined?

As far as I am aware there is no avenues for fining owners for breaches of the laws. In saying that we did have a very disruptive unit owner here a couple of years ago, loud all night parties etc. The police were called and they stated to him that he is in breach of the condop by-laws and after a couple of warnings he sold up and left! A great result for all concerned! I fully agree with a previous poster, the Thai management do not/will not enforce the condo act. Whatever the reason it is very frustrating for the committee to get things done and to get them to adhere to the act, let alone act on overdue payments etc. #7Posted 2012-02-14 16:57:58
Different story Bangkok - very strict and most toe the line. You can fine owners for certain things i.e. late or non-payment of common area fees. Trust me every condo in Chiang Mai has issues and don't forget it is not for the committee to 'manage' but the JPM

One things for sure the law does not say you can but also does not say you can't and that means enforcement will be almost impossible. You could levy the fine 'on account' and not sign the paper if someone wants to sell until they pay? but actually getting owners to give you money for infringements would be almost impossible but many condos charge for using lifts during renovations - no law but people do comply. Let us know how you do I would think that if its voted in as a by-law at an AGM, then yes, it would be legal. Then, like you outlined, the condo would not sign the paper saying all fees are paid up on the unit, hence prohibiting them from ever selling the unit. As long as this is all outlined in the by-laws one would think it would be legal, but best to check with a lawyer that has experience in condo law. Edited by VIBE, 2012-02-15 19:30:17. |
