As soon as I read the title I knew that this thread would be an attempt at slagging off an alleged hiso. And it was.

This is Thailand, not California. However, the concept of Contributory Negligence is a concept in the Thai legal codes. It might be applied here.

Just a thought, but if confronted by a car full of people and you're on your own you might decide discretion is the better part of valor.
I'm sure the OPs relatives are lovely people, but we can't know how they reacted and they did outnumber the Merc driver and shootings and other acts of violence over traffic accidents aren't exactly unknown.
Also, the bottom line is that they hit him from behind. There has to be really clear evidence of extraordinary bad driving by the person in front for it not to be the driver behind's fault, and no evidence has been presented, in this thread at least.

Mini Cooper has been found by the police in a garage being repaired.
Inside the police found the boys student ID card and they also found bullets.
The car is registered to his 80 year old grandmother.
They are chinese thai who own a lot of gold shops.
One of the 4 victims who were run over remembered his car registration number.

Apparently the CCTV camera that views the road it rotates and actually missed the accident but obviously came back and recorded the aftermath.
It was very dark and the pictures are not very good.

They only thing I take out of this is don't drive 140kph. You can assign all the blame you want, it probably won't make things better. Insurance covers what it will cover, after that, good luck. Driving is dangerous and suspectible to human error, rich or poor.

I have no idea who is right or wrong but I "HATE" people that drive Mercs. They always think they rule the road and are nearly always ignorant stuck up people. My opinion!

Not sure about in Thai law but certainly in UK law the rear ended car driver can be charged with driving without due consideration for other road users. e.g. Those following. For instance if they stopped suddenly and unexpectedly at the give way line at a roundabout devoid of any traffic and that has excellent visibility on approach. Or perhaps doing an emergency stop for a baby rabbit crossing the road, knowing they were being followed.
One poster said the good samaritans should have parked immediately behind the accident. Not so unless you happen to be driving a police patrol vehicle which can be lit up like Blackpool immuminations or want your car smashed into as well.

Morning TV news on Ch 3 reports the actual mayhem was caused by a Red Mini Cooper that crashed into some people trying to help the original accident victims. Driver of Mini seems to be an unlicensed 18yo - surprise, surprise!
