Dear Expat members,
A brief circumstance regarding my American boyfriend who is 65 yrs., he is one of those righteous impecunious writer- independent with no pension (he is not likeable but he is a good man who live in the wrong place and the wrong time); existentialistic kind of being, we’ve lived together for 18 yrs. now ( I am 38) he didn’t believe in marriage (I complied with what has been his way all along thinking that it doesn’t matter), we live in some town out of Trang; pragmatic style of life I can say. Southern ambience is unpredictable as we are caring for two slow loris; famine-stricken slow loris and near-electrocute one for the past two yrs, one of us always has to be here.; he would do the visa run to the border every 15 days for a while and get a couple of tourist visa and back to the visa run- it’s quite a hard trip if you are sensitive to the cultural-crash conditioning. It is his choice I think to proceed the way he did, I am just walking along modestly. I think to myself as a true friend I can be, how I can help a man who doesn’t want to be helped – Just do what I can then.
There are two options if I understand them correctly to stay long term provided one meets the requirements. - Non-Immigration O (Extension of stay- Retirement)
-Money deposit in a local Thai bank of not less than 800,000 baht for the past 2 months (1st time) before the date of application; or; Affidavit confirming income of 65k monthly from Embassy and proofs of income; or; a combination of both to meet 800,000 baht.
-Letter of confirmation from Thai bank certifying the account balance before the date of application or up to date.
-Passport with departure card TM.6 and copies of passport data.
-Two application forms T.M. 7, 3 photos (4x6cm) taken within six months and 1,900 baht fee.- Non-Immigration O (Extension of stay –Marriage)
-Money deposit in a local Thai bank of not less than 400,000 baht for the past 2 months before the date of application; or; Affidavit confirming income of 40k monthly from Embassy and proofs of income; or; the combination of both to meet 400,000 baht.
-Letter of confirmation from Thai bank certifying the account balance before the date of application or up to date.
-Passport with departure card TM.6 and copies of passport data.
-Two application forms T.M. 7, 3 photos (4x6cm) taken within six months and 1,900 baht fee.
-Marriage certificate, wife’s ID & House registration, map to residency, picture of house and family, in house and outside showing house number.
-*Two non-family members witnesses and copies of their ID's and address books (Is this a requirement too?)
May I inquire you apart from what I have read through posts which I might have missed many posts that answered the question already.
The account has to be in the name of the applicant only, am I correct? (The ‘And’ account is what we have.)
Does it have to be transferred from abroad?I understand many posts suggest that it has to be transferred from abroad 3 months before, although, some posts seem to say just deposit the money in Thai bank in Thailand 2 months before for the first time applicant and the balance shall meet 800k 3 months before the next visa application.

In order to get retirement extension of stay can he apply for it at the local immigration (here is in Kantang)
In order to get married and he doesn’t agree with Bangkok at all; would it be acceptable regarding ‘Affidavit’ if he would to get it from the US Embassy in Kuala lumpur instead and also get the affidavit translation legalized by the Thai government assumingly the Thai Embassy in KL should be able to do it. (I will try to call BKK Legalization Division again on the working day).
Please know that your thoughts are most appreciated. Thanks very much.

Welcome to Thaivisa - I'm sure Lopburi or others will provide you with a more detailed response to your query.
I have a question though - are you Thai?
If you are not Thai then the "marriage option" is not for you.
If you are Thai & you both marry, he would have to have 400k in the bank OR an income of 40k per month.
I don't think the combination of income & bank deposit is available in the "marriage option".
I stayed long term in Thailand - using the monthly income option(on marriage extensions) for almost all of my time.
This income was from employment in Thailand (which entailed getting a Work Permit etc.)
I'm not sure if this monthly income HAD to be from local employment though.

As said the combination of bank deposit and income is not available for marriage extension of stay - one or the other. And yes money should be in his name for accounts (although some seem to allow latitude on this for marriage). He would have to obtain letter from Embassy in Thailand for marriage (or you could both get married elsewhere). As I said there does not appear to be any requirement for money to be sourced from outside Thailand anymore (indeed this becomes hard to prove for many after transfers and such). It is always best to have an account longer than the required period as less checks are likely to be made but no such requirement. But suspect they would be upset if they know money is really not his.

Thanks very much for the kind welcome PaddyBKK. I am a Thai woman. My dilemma is quite ridiculous really, you might find it a bit of humor if you can see me as another fellow being ( I admire this forum for the contribution it has been given that surely help a lot of foreigners, and I respect the basic of the content which is about the Thai visa ) Honestly, like I said I will just do what I can, and certainly I will do what is right according to the regulations. My boyfriend is of the unusual nature, apart from being a blunt old folk, he has a public mind - too much though - in the wrong time- I no longer hope for him to realize what is- beside of him- my reality is to aware of his conditioning and do the best I can. Together we have 420k saving in 'and' account, you would say then it is easy- just go ahead and get married..ha ha..just to get the affidavit and go through with the translation and legalization believe it or not- it's very hard for him..he would rather dig the well, sweep the street- (excuse my wandering out of the topic again). Anyway the retirement option(the 800k balance account) was my silly plight thinking it would settled the hassle..the reality is I will be trapping myself in another dilemma. So the marriage one is what he can take..if he can take it..

You say that you have 420,000 baht in the bank together. It would be best to put in an account in his name only. To make the extension easier he should go to a Thai consulate and get a single entry non-o. Before marriage he can get one for being over 50 after he can get one based upon being married to you.

As said above you can download the required document from Embassy web site and fill it out for him and make an appointment for the notary service. All he will have to do is pay the $50 or about 1,600 baht fee at Embassy and sign in front of official. Once that is done you can take to translation service and they can take care of the registration with MFA for you. So next thing is you and he visit a District Officer with that paper and his passport and your ID to register marriage. Once that is done he can use either non immigrant O visas for 90 day stays (multi entry would be one year of such stays and from Savannakhet would not even require any bank amount be shown) or get single entry and extend yearly from that with the 400k amount.

This relationship won't last long with the poster talking that way about him on a public forum. Can't image he knows about her posting and the way she speaks of him. (Guess it's a she.) I think he better stay single with visa runs!
