I was scammed by a foreigner. Can I name and shame here?

So I was scammed by a foreigner living in Thailand and I would like to share my story and name the person so people are aware and dont fall victims.

Specific question is

Can I name him here at Thaivisa.com forum?

I do not mind getting sued in civil court for libel.

Make a full draft of your story with details on what, how, when, who and how much!...and copy paste by PM to those who are interested.....could be a way out not to get into trouble....

Absolutely not I'm afraid.

 

Of course there's nothing to stop you posting your story, just no names on the public forum.

 

Just to clarify, defamation / libel is a criminal offence here, custodial sentences are not unknown. To publicly name the person would be unwise to say the least.

Also with consideration to the strong defamation/libel issues....those who post comments, when in Thailand, on hotels/restaurants for instance, on well known travel "Advisor" forms  ... can also get into trouble if their experience is not in favour of the venue. Or am I wrong?

 Possibly; but my understanding is that they could only be sued in Thailand if the site they posted on is based in Thailand.

 

In the UK, for example, the perfect defense of defamation is that what was said or published is true or fair comment. Criticism of a hotel or restaurant would come under one or the other or both; unless such criticism was shown to be based upon unjustified malice. Many other countries are the same or similar.

 

But in Thailand, as the forum rules quoted by ubonjoe above say; neither of these is a defence in Thailand. Also, it is not only the author who can be sued, it's the publishers, in this case Thai Visa, as well.

 

As for being scammed, 3421abc, always remember that if something sounds too good to be true; it probably isn't true!

@ubonjoe if the perp. was named in a PM in response to a no-names post would that still be illegal?

You can write about what happened, but don't identify the person. Members can always PM you for more information in private.

If the defamed or libeled person was made aware of the contents of the PM it could result in legal action taken.

Generally the same rules apply for PM's as they do on the open forum.

Can I put a link to an external site outside of thailand like YouTube or Facebook with the name and photo?

This women Chinese national who lives in Pattaya targets only foreigners and I am afraid there are quite a few.
