The Cosy Beach Hotel has some culpability because it allowed an illegal over stayer  to stay at the hotel and also I thought the police and immigration authorities checked the visitors register and their passport details all usually photocopied

your obviously a short ass ive done it on kitchen units with no problem which would be the same hieght give or take and my dick in the right place. i see by your comment uve had little or no experience in these sorts of positions. stick to missionary

kitchen units are much lower -- tell me your experiences doing it on a standing desk (which would still be lower than the balcony railing).  Given the litigious state of the United States (which often the building standards are based on), I am sure that the design standards take into account the safety of overly amorous individuals on a balcony.  It is probably why they are annoyingly high -- and get in the way of a nice view.

"Fell"  who is to say she wasn't PUSHED ?   I've little reason to believe his recall of events that evening.

Were did that figure of 1500 baht come from? Him or did they find the 1500 in the girls purse or on her? You guess how many customers pay before the sex. He just as likely killed her so he didn't have to pay at all.

The wild sex story may be just a cover story for an impotent evening that ended in his temper boiling over.

Regardless, he can get his sadomasochistic sex in prison, weeee!

No, but to me from the picture the rail seems to be about 120cm high at least (based on the back of the chairs and the table height) -- maybe a little more.  A man having his legs on the ground - the force of the thrust would be forward - towards the rail.  Upper body strength of the Thai girl is not going to be that strong -- strength means thickness, and thickness is not considered attractive.   So a Thai girl bent over in a wheelbarrel or upright will be thrust directly into the rail - which would lead to severe bruising and/or potentially broken ribs -- at least the amount of force that it would take to lift someone up 30cm using a forward thrust.  Now the body is covered with skin, some fat, water, it bends (all of this will dissipate a significant amount of the energy of the forward thrust) - so that would actually make it harder with that force to "accidentally" launch her up and over the barrier.   And all this force is not just once - but over and over again - with supposedly would send her over the barrier?  That to me sounds like she would be in significant pain long before that point.  Even raised up 10cm the average Thai girl is between 150 to 160 cm tall.  The centre of balance is going to be lower than the barrier - forward thrusts towards the barrier.  The theory would therefore need a demonstration of some sort before it would even be considered.  Best case scenario is it is still a minimum of negligent homicide.  Now that he has made the statements - any change in statement would definitely not help his case....  It is why (guilty or not) you never make any statements to police without first contacting your lawyer.  Luckily for us -- he did not turn himself in and felt the need to explain himself which has more or less locked himself into a story without the ability to really test it out.

BTW, That looks pretty much a very close copy of the railing on my Condo in Toronto (24th floor).

All this Physics and Math babble about height of balcony, height of woman and her centre of gravity,  width of railing, and penis/thrust angles  being spouted by so many could be explained  away if the police find a footstool in the condo.

No, it cannot be explained away by anything - since he has made statements to police already.  As such he is locked into the story he has given.  If he omitted something in the story that he later tries to include in his story -- because his original story is shown not to be a reasonable explanation...  his original statements can and will be used against him - including omissions.  He will then have to answer additional questions on why he was dishonest in his first statement (which in itself is incriminating).  That raises the bar on any other explanation being able to be considered reasonable.

Even if you introduce a stool into the equation - were their two stools - one for him to raise him up, one for her to raise her up - or were they both on the same stool and then he picked her up further....  then the question - is that reasonable - and why would you stand on a stool.  Remember the statement is that "they" came to an orgasm, unless he was ALL legs and no body -- her on the stool and having sex where "they" (not he, not she, they) came to an orgasm.... that is the statement he is locked into -- any change from there would likely be taken as a sign of guilt.

Making an absolute conclusion on this case is naive.

There are many reports of people who have been subjected to much more trauma and higher falls which resulted in absolutely no injury.

But if you have some sort of CSI expertease,  give it a shot....

Armchair Colombo club is alive and well it seems.

As stated earlier. Ask him to clearly draw a picture of the position. If he draws a stool fine if not then take him to the location and ask how its physically possible. Either way it has happened and she has died due to negligence thus can face up to 10 years in Thai prison and face a fine of up to 200,000 Baht. Given his previous convictions in his home country I would think the sentence will likely be near maximum time.

Maybe better to wait for the actual verdict rather than continue with this never ending betting sentence competition which does not lead anywhere...??...;)

If you are now saying that no one should post their opinions about the case (or for that matter anything else) - this thread would be 25 pages smaller.  The fact is that for the most part we are just commenting on the work of the police so far -- since they were the ones that identified the person of interest, they are the ones that brought him in for questioning, and it was them (or more likely the prosecutor -- since this is a serious charge) that felt the appropriate charge based on primarily his statement alone (at this point) -- warrants a negligent homicide charge.  Police tend to charge with the evidence at hand, and while the investigation is ongoing -- the evidence would likely only be additive to the base charge that they submitted.  The discussions on what we are each of us think the sentencing will be is just really an estimated guess - based on the law, and any additional information that is available to the judge to use for sentencing.  This is after a discussion board - which by the very nature solicits facts AND opinions - in hopefully a mature and open discussion.

It is precisely such a misunderstood and unnecessarily long post without any kind of value for the case that contributes greatly to the fact that we soon pass 30 pages - this for thought when the writing itch for real puts in...;)
