Got news for the headline writer here:

 

Digital penetration in the absence of consent IS legally RAPE!

 

If that's what in fact occurred, then the victim was in fact RAPED!

 

BTW, despite the headline, the OP article, or at least the English translation of the Thai version, doesn't have Joke explicitly saying what happened was NOT rape. It merely has him saying the hospital exam didn't find any "evidence" of rape, which in the case of digital penetration, there wouldn't necessarily be any evidence to find.

 

I have no idea what the original Thai language version has Joke saying or not saying.

The other English newspaper has stated that the accused has been charged with rape. The police stating that penis or finger is still rape according to Thai Penal Code.

So section 276 refers to less than 15 year old rapists or under 15 year old victims.  If so, why the charge for a 14 year old for sushi maker?

There are no excuses for the man. Knowing she was drunk and maybe passed out. How many times are we going to read of women getting drunk then going off with men they don't know? It's just asking for trouble.

Actually, it wasn't taken from Wikipedia, for the same reason as you yourself cite in your post. It was taken from an online dictionary. 

I do however concede to the point you post re the UK Met. Police. Thanks for the clarification. :thumbsup:

Would Thai police view the above as law......from the article it would seem so.
